Nikah Guide: Valid Marriage, Mahr, Witnesses and Registration

Five pillars make a nikah valid, civil law makes it recognized. Wali, witnesses, mahr, khutbah and registration for UK, USA, India and Pakistan.

01 · The five pillars of a valid nikah

One, the bride's free consent through her wali. Two, two male witnesses, or one male and two females. Three, an agreed mahr, written and witnessed. Four, the khutbah and the offer and acceptance in one sitting. Five, civil registration so the state recognizes what Allah already joined.

Miss the first four and scholars question the nikah itself. Miss the fifth and the marriage is religiously valid but legally invisible, which destroys inheritance, visa and custody rights.

02 · Mahr: her exclusive right

Quran 4:4 orders mahr paid graciously to the bride alone. No fixed amount exists. Umar's attempted cap was publicly corrected with the same verse's twentieth ayah. Whatever both sides agree stands.

Split it wisely: enough prompt to be real, the rest deferred as her security, both figures written into the nikahnama. The Mahr-e-Fatimi benchmark, about 1575 grams of silver, offers a dignified middle most families respect.

03 · Civil registration by country

United Kingdom: nikah alone is not legally binding. Register at a registry office or an authorised mosque. United States: county marriage license plus authorised officiant, with rules varying by state. India: nikahnama plus registration under Muslim Personal Law or the Special Marriage Act. Pakistan: nikahnama registered with the union council and NADRA.

Nikah questions

Is nikah without witnesses valid?

No. Two witnesses are a pillar. A secret marriage without them is invalid in all four schools.

Can the bride choose her own husband?

Her free consent is essential. A forced nikah is invalid; the Prophet ﷺ annulled one.

Is court marriage enough?

Civil registration alone is not nikah. Do both: the religious contract and the state's paper.
